By accessing this webpage, you agree to be bound by these Terms and Conditions ("Terms") in a legally binding agreement between us ("I PRITH SECURITIES PRIVATE LIMITED", "we", "us", or "our") and you ("User/Client ", "you", or "your"). Please read these Terms carefully before using the Website. If you do not agree, you may not access the Platform.

We reserve the right to update or change the Terms and Conditions by posting updates on the Platform. You should review this page from time to time for any updates or changes that may impact you. If any amendment is not acceptable, please cease using the Platform.

Eligibility

You represent and warrant that you have the right, power, and authority to agree to these Terms, to become a party to a legally binding agreement, and to perform your obligations hereunder.

Definitions

“Payment Instrument” includes credit card, debit card, bank account, prepaid payment instrument, Unified Payment Interface (UPI), Immediate Payment Service (IMPS), or any other payment methods developed or added by banks and financial institutions.

“Platform” refers to the website or platform where the Merchant offers products or services and where the Transaction may be initiated.

“Transaction” means the order or request placed by the User with the Merchant to purchase products and/or services listed on the Platform by paying the Transaction Amount to the Merchant.

“Transaction Amount” means the amount paid by the User in connection with a Transaction.

“User/Users” means any person availing products or services offered on the Platform.

“Website” refers to www.instamojo.com or the mobile application.

Merchant's Rights

We may collect, store, and share information provided by you in order to deliver the products and/or services availed on our Platform and to contact you regarding those services.

Your Responsibilities

You agree to provide true, complete, and up-to-date information about yourself as required for completing Transactions. This information includes, but is not limited to, name, email address, phone number, delivery address, age, gender, and accurate payment information.

Prohibited Actions

You may not access or use the Platform for any purpose other than that for which it is made available. The Platform may not be used for any commercial endeavors except those specifically endorsed or approved by us. As a User, you agree not to:

• Systematically retrieve data or other content to create compilations, databases, or directories without written permission.
• Collect usernames or email addresses for unsolicited communication, or create accounts by automated means or false pretenses.
• Circumvent, disable, or interfere with security-related features of the Platform.
• Attempt to trick, defraud, or mislead us or other users.
• Misuse our support services or submit false abuse reports.
• Engage in automated system use such as scripts, bots, data mining, or other extraction tools.
• Interfere with or create an undue burden on the Platform or related services.
• Impersonate another person or use another user's username.
• Use information obtained from the Platform to harass, abuse, or harm another person.
• Use the Platform for revenue-generating competition or unauthorized commercial use.
• Reverse engineer, decompile, disassemble, or otherwise attempt to access the Platform source code.
• Bypass measures that restrict access to the Platform or any portion of it.
• Harass, intimidate, or threaten our employees or agents.
• Copy or adapt the Platform's software, including Flash, PHP, HTML, JavaScript, or other code.
• Upload or transmit viruses, malware, spam, or any material that disrupts the Platform.
• Disparage, tarnish, or harm us or the Platform.
• Use the Platform in violation of applicable laws or regulations.

Limitation of Liability

The User agrees that the only recourse for receiving a defective product or deficient service is to initiate the refund process subject to the refund terms under this agreement. We expressly disclaim liability for any losses in such cases. You agree to indemnify and hold harmless the Merchant and its affiliates, agents, and representatives from any claims, liabilities, losses, damages, costs, or expenses arising from any breach of these Terms by you.

Guidelines for Reviews

We may provide areas on the Platform to leave reviews or ratings. When posting a review, you must comply with the following:

• Only post reviews based on firsthand experience.
• Avoid offensive, abusive, racist, sexual, or hateful language.
• Do not include discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
• Do not reference illegal activity.
• Do not post false or misleading statements.
• Do not organize campaigns encouraging others to post reviews.
• Do not make legal conclusions in reviews.

We may accept, reject, or remove reviews at our sole discretion, and we have no obligation to screen or delete reviews. Reviews do not represent our opinions and are not endorsed by us. By posting a review, you grant us a perpetual, worldwide, royalty-free license to reproduce, modify, translate, distribute, and display that content.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India. You and we agree that the courts of India will have exclusive jurisdiction over any dispute. Any dispute arising out of or relating to these Terms shall be referred to arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996.

Within 30 days of issuing a notice of dispute, the parties shall mutually appoint a sole arbitrator. If no agreement is reached, the arbitrator will be appointed under the Act. The seat of arbitration shall be India and the proceedings shall be conducted in English. The arbitration will remain confidential except as required by law, and the arbitrator's decision will be final and binding.

The cost of arbitration shall be borne as determined by the arbitrator, with each party initially bearing its own costs unless directed otherwise in the award. Either party may seek injunctive relief from courts in Bengaluru when appropriate.

If you have any questions or complaints regarding products, services, fraudulent or unauthorized transactions, refunds, or other issues, please contact our grievance redressal team using the support details provided on the Platform.

Disclaimer

By initiating a Transaction, you enter into a legally binding contract with us to purchase products and/or services and agree to pay the listed price through legitimate payment sources and accepted Payment Instruments. You must provide accurate payment details for secure processing.

Information you provide may be used or shared with third parties for fraud verification or as required by law. We disclaim liability for any unauthorized use of a User’s Payment Instrument.

All payments are made at your own risk. We are not liable for loss or damage arising from authorization declines, malfunctions, errors, or unauthorized activity.

If you receive a user ID, order ID, password, or other security information, keep it confidential and do not share it with third parties.

The content on our Platform is provided for general information only and should not be relied upon as advice. Links to third-party websites are for convenience only and do not imply endorsement.

Information uploaded by other Users has not been verified by us. User content does not represent our views or values. We do not guarantee that the Platform is secure or free from bugs or viruses. You are responsible for your own device security and software configuration.
